Welcome to the PWR Build (Pty) Ltd website/s (“Website/s”) and hereinafter referred to as Power Build. Please take a moment to read these terms and conditions including Power Build policies (collectively the “terms”) to understand how they apply to you the customer (“you”) and your use of the various Power Build Websites and any Power Build products (“Products”) or services (“Services”) that you may make use of online.

The PWR Build (Pty) Ltd (hereinafter referred to as “Power Build”) group consists of multiple entities, brands, members, other groups and suppliers, including, but not limited to:

• Power Build 
• Mega Paints
• Independent Store Members
• Groups such as Autobarn, and others, which includes their members and suppliers collectively
• Suppliers listed with Power Build
• Other entities that join the group or affiliated with our services in the future

These terms apply to all interactions made online from our Website/s. Please read these terms carefully and ensure you understand them. Use of and/or registration on any aspect of the Website will constitute your agreement to comply with these terms. Important clauses, which may limit Power Builds’ responsibility or involve some risk for you. Some of these provisions have the effect of limiting your rights in law and conferring obligations on you by virtue of your agreement to these terms. You agree to pay special attention to these clauses.

Online Registration
Registration as a user on the website is free and does not oblige you to purchase anything. You are required to  register with us before utilising the confidential content made available to members and suppliers to our group..

Registration and/or use of the Power Build Websites constitutes your acceptance and agreement to be bound by the terms and conditions of the Power Build Websites. To register you will be required to provide certain personal information which is protected by Power Builds’ Privacy Policy. When registering with us you will be required to provide an email address and a password which will be used as your username and password for the Websites. Please keep your password private as Power Build accepts no liability for any damages suffered or losses incurred from the use or misuse of your account.

You will be required to enter your username and password each time you log into a private or confidential, or secure section of the Website. To amend any registration particulars please edit your details in the profile link, or equivalent, provided. When registering as a purchaser you are required to provide Power Build with complete and accurate information about yourself. By doing so you warrant that the information provided is correct.

Products

Product Images and Representation

We have made substantial efforts to display Products and services on the Website as accurately as possible, including:

• the images that represent a visual depiction of the product
• features and descriptions that pertain to the product
• SKU numbers
• Pricing
• Unit of measure
• Minimum Order quantities
• Supplier details
• And other relevant information

The actual Product delivered may be subject to variations in appearance, as product packaging may differ over time. It remains the responsibility of the customer to ensure that the product he/she ordered, or enquired about is correct, and the product description and/or model number will always overrule any related images when resolving a dispute about a product.

Product Pricing, Availability and Delivery

The products displayed on the Website are subject to availability and will be delivered within the regions specified (per supplier) only, and more specifically only within the areas as determined by Power Build. 

All prices displayed on the Website are valid and effective only in the regions specified for the validity period also indicated on the site (E.O.E). Power Build reserves the right, without prior notice, to discontinue or change pricing or specifications of products and services offered on this Website without incurring any liability whatsoever.

Power Build cannot guarantee availability of stock but will endeavour, through the participating suppliers, to ensure that stock-outs are minimised.

Inadvertent and Obvious Errors

Whilst substantial precautions are taken to provide the correct information on the website, in the event that we identify an inadvertent and obvious error in the price, product or service description, images and any other relevant content, the supplier nor Power Build, is not obliged to provide you with the affected product or service.
Power Build, or the supplier, or the site administrators, will make an appropriate effort to contact you to alert you of the error. In such circumstances you are entitled to cancel the enquiry/purchase per your terms and conditions with the relevant supplier/s..

Product Reviews

Where, and if applicable, by submitting Product reviews to Power Build, you represent and warrant that:
You understand you may be participating in a public forum and that your submitted content and other personal information may be available to other users of the site/s, the community and potentially third party sites.

When you submit a review, you agree to the following:

• All review(s) submitted are accurate
• Your review is original and was created by you
• You are a resident of South Africa or other surrounding country that Power Build operate,; and are at least eighteen (18) years of age
• You are currently a bona fide buyer/user of the of the product you review
• You are not an employee of the supplier nor do you work for an affiliate or agency of the supplier 
• The statements you make in your review reflect your true and honest opinion of and current experience with the products which you review..

Power Build shall have the right, but not the obligation, to pursue any one or more of the following actions with regard to your review(s):

• We reserve the right to monitor/review your review;
• We reserve the right to edit your review – Power Build may correct any spelling and grammar issues if necessary, but won’t intentionally change the original meaning;
• By submitting a review, you grant the right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout Power Builds’ marketing channels in any media;

Enquiries

Enquiries placed online constitute your appropriately intentioned,  “no obligation” enquiry, for additional  information from the relevant supplier promoting their products on the Power Build wesbite/s. The Power Build website/s act merely as a value adding facilitation of communications between our members and suppliers. The responsibility to action/respond to the enquiries placed via these websites, is for the relevant supplier registered to that enquiry as a “vendor/Supplier” promoting their products/services.

Power Build have no obligation, or responsibility to reply to, or follow up on, enquiries made on the website/s and act merely as a value adding facilitation for these communications.

Purchases

Should any purchases be made as an outcome of the website/s, the terms and conditions and all legal obligations are strictly between the members (store) and the supplier (vendor) and Power Build have no obligations related to these enquiries and/or orders.

Intellectual Property

All intellectual property rights, including copyright, in all materials, including trademarks, logos, photographs, images, text and other graphics which form part of the Website/s are owned by Power Build alternatively Power Build is the lawful licensee thereof. Such rights are protected by both South African and international intellectual property laws. All data and information communicated to or from the Website/s and/or any Website information as well as the database is the sole property of Power Build.
